Your Workers’ Compensation Questions Answered

If you have been injured on the job, you may have many questions about the workers’ compensation process and your benefits. At Laurie W. Maschek, Attorney at Law, LLC, in Slidell, we are always happy to share our knowledge of Louisiana workers’ comp laws with our clients. Following are some of the most common questions we receive from injured workers.

What Benefits Am I Entitled To?

If your injury was job-related, you are entitled to workers’ compensation benefits. Depending upon the nature and severity of your injury, your benefits may include:

  • Medical expenses, including hospitalization, medication and rehabilitation
  • Temporary total disability benefits (for lost wages)
  • Permanent disability benefits
  • Vocational assistance

If you are temporarily disabled, your wage loss benefits will equal two-thirds of your average weekly wage, capped at a maximum amount set by law every year.

What If My Claim Is Denied?

If your claim is denied, do not despair. You may file a disputed claim for compensation and have your chance to argue your case before a Louisiana workers’ compensation judge. Of course, you don’t have to do this yourself. Our law firm will handle all aspects of the appeals process on your behalf.

Do I Need To Hire An Attorney For My Workers’ Compensation Claim?

Not every worker injury requires the attention of a workers’ compensation lawyer. If your injury is severe, however, a knowledgeable attorney will give you a much better chance of obtaining the benefits you need, compared with handling such a complex legal matter on your own. When you hire a workers’ compensation attorney, you don’t typically have to pay anything upfront. The attorney’s fee will be paid as a percentage of your award — if and only if you receive one.
